Marriage after Divorce

The Starting Point

The Church of England teaches that marriage is for life, but it also recognises that some marriages sadly do fail and, if this should happen, it seeks to be available for all involved. The Church accepts that, in exceptional circumstances, a divorced person may marry again in church during the lifetime of a former spouse.

The Process

In this parish the clergy are willing to discuss the possibility of such a marriage. We would need to talk openly and honestly about the past, your hopes for the future and your understanding of marriage. You and your partner should therefore be prepared to consider some questions about these matters and to reflect on the issues they raise.

Some people find it too painful to go over old ground in this way, and while we try not to be too intrusive, there are questions we need to ask to get a fuller picture, and see whether we can make an exception in your case.

You should bear in mind, however, that remarriage in church is most unlikely to be possible if either partner has been married and divorced more than once.

If you wish to proceed with your enquiry, you and your partner will be asked to meet with two members of the parish clergy to reflect together on your situation. More than one such confidential interview may be required. The purpose of this conversation will be to discern whether remarriage in church is appropriate to your circumstances or whether the Church could offer you a service of prayer following a civil marriage instead.

Although the final decision rests with the parish priest who would expect to officiate at the service of marriage or prayer, he or she will also consult with the colleague who shares the interview process with you in the parish. It may also be necessary to consult the Bishop or an advisor before a decision is made. You can, however, be sure that any such consultations will be confidential.

This process could take some time and it is important to realise that no definite arrangements for any kind of service can be made until it is completed. Your priest will be happy to discuss the possible timescale with you.

Legal Requirements

You should also note that in order to fulfil the legal requirements, it is often only possible to be remarried in church if you or your partner are actually resident in the parish. Your priest will need to check this residential qualification with you at an early stage of your enquiry.

If you decide to enter into the process you will need to complete the relevant application form, available from your priest, and return it to him or her before the date agreed for your interview. Please note that both partners need to complete the form. You will also need to supply your original Decree Absolute with the completed form. A copy is not acceptable and the Decree Nisi is not sufficient.
